1. Agreement to Terms
By accessing or using Subtrack ("Service"), operated by EDC Properties Inc. ("Company," "we," "us," or "our"), a Wyoming corporation, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
Subtrack is a subscription and renewal tracking platform that helps individuals and organizations monitor, manage, and receive alerts for their subscriptions, domains, certificates, and recurring services. The Service may include integrations with third-party providers, email scanning, browser extensions, and financial data connections.
3. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to other accounts, systems, or networks
- Interfere with or disrupt the Service or servers connected to the Service
- Reverse engineer, decompile, or disassemble any portion of the Service
- Use the Service to collect, store, or process data in violation of privacy laws
- Resell, sublicense, or redistribute the Service without our written consent
5. Subscription Plans and Billing
The Service offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) as selected at the time of purchase. You authorize us to charge your payment method for the applicable fees. All fees are non-refundable except as described in our Refund Policy.
6. Third-Party Integrations
The Service may integrate with third-party services including but not limited to domain registrars, cloud providers, email services, and financial data providers. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the availability, accuracy, or security of third-party services.
7. Financial Data
If you connect financial accounts through the Service, you authorize us and our financial data partners (including Plaid Inc.) to access your financial data solely for the purpose of identifying subscriptions and recurring charges. We do not store your banking credentials. See our Privacy Policy, Data Protection Policy, and Financial Data Practices for details on how financial data is handled. By using Plaid through Subtrack, you also agree to Plaid's end-user services agreement.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by EDC Properties Inc. and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.
9. Data Ownership
You retain all rights to the data you submit to the Service. By using the Service, you grant us a limited license to process, store, and display your data solely for the purpose of providing and improving the Service.
10. Limitation of Liability
To the maximum extent permitted by law, EDC Properties Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that renewal alerts will be delivered without delay. You acknowledge that you are solely responsible for managing your subscriptions and renewals.
12. Termination
We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases and we may delete your data after a reasonable retention period.
13. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Wyoming.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
